Gonzales v. Carhart: Giving Voice to Our Humanity

In upholding the constitutionality of the federal Partial-Birth Abortion Ban Act of 2003, the Supreme Court today gave voice not only to the humanity of the developing unborn child, but also to our ideals as a fundamentally humane society.

Justice Kennedy's opinion likewise demonstrated a measure of intellectual honesty in underscoring the notion that abortion rights are not "carte blanche". This decision, while clearly not sweeping, still clearly repudiates the notion that a woman has unlimited "rights" when it comes to the competing rights of a viable, developing unborn child to be subjected to this grisly barbaric procedure. For that matter, none of us have unlimited "rights" - my rights end where yours begin.

The Court also poked huge holes in the "health" exception arguments propagated by Carhart, et. al.
